Our member experienced sustained workplace bullying that led to allegations against them and an internal investigation.
IWUA stayed with the member through the investigation and everything that followed.
When informal steps did not resolve it, IWUA filed a General Protections (non-dismissal) claim with the Fair Work Commission on behalf of the member. The matter went to a hearing, and settlement was negotiated from there.
The member came away with a deed covering:
- Non-disparagement
- A positive reference
- An ex-gratia payment of four weeks' pay
IWUA also had a clause added so the member would not be blocked from future work with the employer.
From first contact to settlement, IWUA stood by the member for close to four months.
